SOSI MAKES NO WARRANTY REGARDING ANY GOODS, INFORMATION OR SERVICES PURCHASED OR OBTAINED THROUGH THE USE OF THE SOSI MAIL AND INTERNET SERVICE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT TO USE SOSI SERVICES AND ABIDE BY THE SOSI ACCEPTABLE USE POLICY.

LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL SOSI OR ITS LICENSORS OR RESELLERS BE LIABLE TO THE CUSTOMER OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM THE USE OF OR THE INABILITY TO USE THE SOSI MAIL AND INTERNET SERVICE, THE PERFORMANCE OF SOSI MAIL AND INTERNET SERVICE, OR DAMAGES FOR LOSS OF GOODWILL, BUSINESS PROFIT, BUSINESS STOPPAGE, LOSS OF DATA OR BUSINESS INFORMATION, COMPUTER DAMAGE, OR DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR CHANGES MADE TO CUSTOMER'S TRANSMISSIONS OR DATA, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

SERVICE LIMITATIONS: SOSI PROVIDES MAIL AND INTERNET ACCESS FOR A FEE. SIGNING UP AS A CUSTOMER OF SOSI MAIL AND INTERNET SERVICES DOES NOT MAKE SOSI RESPONSIBLE FOR THE CARE, UPKEEP, OR SERVICE OF THE CUSTOMERS COMPUTER. SOSI IS NOT RESPONSIBLE OR OBLIGATED TO EDUCATE THE USER IN THE USE OF A COMPUTER OR ANY SOFTWARE PROGRAMS THAT MAY BE ON THE CUSTOMERS COMPUTER. SOSI RESERVES THE RIGHT TO CHARGE ADDITIONAL FEES TO ANY CUSTOMER REQUESTING SUPPORT OUTSIDE THE NORMAL "GET CONNECTED" TELEPHONE SUPPORT CURRENTLY PROVIDED BY SOSI. SUCH CHARGES SHALL BE BILLED AT $75.00 PER HOUR WITH A MINIMUM FEE OF $35.00 FOR ANY TELEPHONE SUPPORT TIME LESS THAN 30 MINUTES.

SOFTWARE: SOSI PROVIDES A MAIL AND INTERNET BROWSER AS A COURTESY SHOULD THE CUSTOMER NOT HAVE ONE. SOSI MAKES NO WARRANTY OF THE BROWSER SOFTWARE AND IS NOT RESPONSIBLE FOR THE SUPPORT OF THE SOFTWARE. THE CUSTOMER USES THIS SOFTWARE AT THEIR OWN RISK. SUPPORT FOR THE PROVIDED SOFTWARE SHOULD BE ADDRESSED TO THE MANUFACTURER OF THE SOFTWARE, EITHER MICROSOFT OR NETSCAPE. SOSI WILL PROVIDE LIMITED ONLINE AND PHONE SUPPORT FOR ASSISTING THE CUSTOMER IN ENTERING THE PROPER SETTINGS INTO THE SOFTWARE. CUSTOMER IN NEED OF CONSTANT SETTING SUPPORT MAY BE CHARGED THE ADDITIONAL SUPPORT FEES.

CONNECTIONS: SOSI MAKES EVERY ATTEMPT TO PROVIDE THE FINEST SERVICE POSSIBLE. ALL MODEMS ARE 56K, V.90 AND ARE INSPECTED ON A REGULAR BASIS. SOSI IS NOT RESPONSIBLE FOR ANY POOR CONNECTION SPEED THE CUSTOMER MAY GET. SOSI CAN NOT CONTROL THE QUALITY OF THE CUSTOMERS PHONE LINES AND HAS NO CONTROL OVER THE TELCO THE CUSTOMER MAY BE USING. SOSI IS NOT RESPONSIBLE FOR ANY LONG DISTANCE CHARGES THE CUSTOMER MAY INCUR WHILE USING SOSI'S SERVICE. THE CUSTOMER MUST CHECK WITH THEIR LOCAL OPERATOR TO INSURE THEIR LOCAL DIALUP NUMBER IS LOCAL TO THEM.
