ACCEPTABLE USE POLICY

This Acceptable Use Policy ( the "Policy") is written to protect both Superior Online Services Inc., hereinafter called SOSI, and each of the customers of SOSI. It is the intent of this Policy to insure that each of SOSI's customers is knowledgeable of proper Internet "Netiquette" and fully understands what SOSI considers proper and correct behavior on the Internet.

This Policy is an agreement between SOSI and the dial-up account holder (hereinafter called "the customer") and supersedes any previous agreements, either oral or written with respect to the subject matter covered herein. This Policy is considered to be in effect as of the date it is placed on the SOSI server. SOSI reserves the right to modify this Policy at any time. SOSI reserves the right to change its price structure as may be required and to refuse or discontinue service to any customer at any time.

The Posting on the SOSI server shall be deemed adequate notice to the customer of any changes to this Policy. If you refuse to agree to this police, please do not use any SOSI service and notify our office at (559) 789-9434, and we will terminate your account. No refunds are due to any customer whose account is canceled by SOSI for the customer's failure to comply with this Policy after acceptance.

1.0 TERMS OF SERVICE

1.1 SOSI provides personal and commercial dial-up accounts to customers that allow access to the Internet in exchange for a fee.

1.2 SOSI provides access to the Internet only. SOSI is not the Internet nor does SOSI have any control over the Internet. SOSI does not monitor the activities of customers or other users on the Internet nor does it monitor the E-mail activity of any customer. SOSI considers Email to be as private as sending a letter through the U.S. Postal Service. SOSI will not edit or censure any email content. However, any Email that is brought to our attention that may include any illegal substance will be turned over to Law Enforcement authorities. SOSI does reserve the right to monitor customer Login dates, time and usage.

1.3 SOSI is not responsible for the content on the Internet or the ability of a customer to access any server or site on the Internet. SOSI is not responsible for the content of any file or software that may be downloaded from any server or site on the Internet. SOSI is not responsible for any damage caused by or resulting from the downloading of files or software from the Internet.

1.4 SOSI provides access to "Chat" and "News" groups only. SOSI is not responsible for the content, or customer, or third party use of these groups.

1.5 Customers who allow their minor children to use the Internet are responsible for the conduct of such minors. The Internet contains subject matter that may be considered obscene and offensive. Adults who allow minors access to the Internet are responsible for allowing such access and may be held accountable and subject to all applicable Federal, State, and Local laws.

1.6 Minors who use the Internet are presumed to have the permission and supervision of an adult customer.

1.7 SOSI is not responsible for the actions of any Internet user.

1.8 SOSI customers must be 18 years of age.

1.9 The customer is responsible for any third party use of the customer's account.

1.10 SOSI does not condone or allow the unlawful use of the Internet. SOSI does not allow customers to use their account to use abusive, threatening, harassing, obscene, hateful or otherwise objectionable behavior. When such behavior is brought to our attention, SOSI will contact the offending user and ask the to cease the offending activity. If the offensive behavior continues after being warned, SOSI will take such action as SOSI deems appropriate. Up to and including the termination of the users account.

2.0 USE AND DISTRIBUTION OF MATERIALS ON THE INTERNET

2.1 Materials that are considered to be Public Domain materials may be downloaded or uploaded using SOSI services. Public Domain materials may be re-distributed using SOSI services. The customer assumes all responsibility in determining what materials are Public Domain materials.

2.2 The customer may not use SOSI services to violate any copyright laws or the laws of any Government, foreign or domestic with regard to materials and copyright laws. The customer warrants that any materials used to publish on the Internet are not in violation of any laws, willfully or otherwise.

2.3 SOSI is not responsible for any material or information that any Internet user may obtain from the Internet and SOSI assumes no responsibility for the content or accuracy of the information obtained on the internet.

3.0 PURCHASING OF GOODS AND SERVICES ON THE INTERNET

3.1 The customer assumes all responsibility for the purchasing of goods and services on the Internet. SOSI does not warrant or guarantee any goods or services that are purchased on the Internet, except for those products or services that may be offered by SOSI.

3.2 If a customer is offended by the goods and services offered on the Internet, it is the customer's responsibility to not go to these sites. SOSI will not block or "Firewall" any sites or materials on the Internet.

3.3 SOSI takes no responsibility and has no control over what a customer may say , read or hear on the Internet.

3.4 The customer agrees not to share their username and or password. Concurrent use of services, without proper permission or payment for such services, will result in the immediate termination of the customer's account. The customer will be responsible for any additional charges that may be due as a result of concurrent usage.

3.5 If a customer's account is suspended or terminated as a result of misuse, the customer will be charged any fees as may be required to reactivate and establish the customer's account should SOSI agree to re-establish the account. SOSI shall have no obligation to re-establish an account that has been suspended or terminated.

3.6 The customer is fully responsible for behaving in a legal manner on the Internet and while using any SOSI services.

3.7 Unlimited service means that the customer must be actively using the dial-up service through means of active keystroking. Any account that is found to be idle for more than 15 minutes will be disconnected.

3.8 The customer will not use any service or program to attempt to obtain nor use any other customer's password or username.

3.9 SOSI reserves the right to E-mail its customers to keep them informed of new products and services offered by SOSI and to keep the customer informed of any changes in current services.

3.10 SOSI is not responsible for service interruptions due to equipment failures, telecommunication service failures, Bandwidth shortage, human error, server delays, weather, acts of God or any other instance that is beyond the control of SOSI.

4.0 ABUSE OF SOSI SERVICES

4.1 Any customer or third party attempting to "hack" into the SOSI system to gain access for any reason will be prosecuted to the fullest extent of the law.

4.2 Emulators may not be used on SOSI services without the written permission of SOSI which permission may be withheld in the sole and absolute discretion of SOSI. Any use of such devices or any other device that keeps an account actively online, with or without a user presence, will result in the termination of the customer's account.

4.3 SOSI does not allow the misuse of E-mail in the form of mass marketing. Spamming, or Bombing or the improper posting of messages on news servers is considered a misuse of SOSI services. SOSI reserves the right to block mass E-mail solicitations or "junk E-mail".

4.4 SOSI customers may not use annoyance utilities such as "Flash", "Nuke", or employ packet sniffers, tsunamis, flood bots or flood pings.

4.5 All Email Accounts are restricted, limited to 5 Megs of server space. Any user that exceeds 5 Megs of server space will be charged for the overage and the account will be reset to zero Kilobytes. Violators of the 5 meg limit will receive an Email notification that the account will be reset in 24 hours. Business users that desire more server space must make arrangements with SOSInet for additional payment for space to avoid any account from being reset. Addition Email and web space is $1.00 per Meg, per month. Web sites that exceed size limits will also be billed at $1.00 per Meg, per month, for all overage.

5.0 INDEMNIFICATION; TERMINATION OF ACCOUNT

5.1 The customer agrees to defend, indemnify and hold harmless SOSI, its affiliated companies, telecommunications providers and ISPs from all liabilities, claims and expenses, including attorneys fees that may arise as a result of a customer violating this policy. SOSI reserves the right to assume exclusive control over any matter that may occur.

5.2 The customer agrees that SOSI has the right to terminate any account, at any time, with or without notification. The customer further agrees that SOSI may suspend and account for non-payment and that and additional charge will be added to the account for re-activation.

5.3 For an account to be canceled by a customer, the customer must notify SOSI, in writing, in advance of the cancellation date. Notification of cancellation must be sent to SOSI. Notifying a reseller of SOSI is not considered as acceptable notification of cancellation.

5.4 The customer is responsible for insuring that SOSI and not a reseller of SOSI receives any and all payments, changes and cancellations with regard to the customers account.

6.0 CHARGES AND BILLING PRACTICES

6.1 Rates and current charges may be obtained at any time by accessing the SOSI home page pricing section under "Services". The customer may also call (559) 789-9434 for the latest pricing information. Prices do not include any government taxes or fees that may be chargeable in the customer's living area.

6.2 The customer is responsible for payment of any and all taxes, surcharges or any other applicable government fee arising from the customer's use of services provided by SOSI. Customers are responsible for all web site overages. Overage are charges at $1.00 per Meg, per month for all Email and web site overages.

6.3 The customer is responsible for any long distance phone charges that may occur while using the Internet. Some areas require a long distance call to access the SOSI services. The customer is responsible for determining if the call to access the SOSI services is a long distance call. Please call your local Telephone company to determine your charges with respect to the number provided to you by SOSI.

6.4 If the customer has elected to pay by credit card and SOSI does not receive payment from the card issuer or its agents, the customer agrees to pay all amounts in full upon demand. The customer's use of SOSI services constitutes the customers reaffirmation of any agreement and that SOSI is authorized to charge the customer's designated credit card or withdraw funds via electronic funds transfer from the customer's checking account . The customer agrees that SOSI has the right to accumulate charges during a billing cycle and to bill those charges as a single charge. The customer agrees that SOSI may delay obtaining authorization from the customer's card holder until the submission of accumulated charges.

6.5 SOSI will bill or invoice the customer each month for services. All services are billed in advance of services rendered. A customer that cancels their account by the 10th of the month will be charged a prorated fee for the month to the date of cancellation. Any account cancellations received after the 10th of the month will be billed for the full month. Notice of cancellation must be actually received by SOSI to be effective.

6.6 Monthly fees are due , in advance, on the first of each month and are delinquent if not received by SOSI by the 15th of the month. Accounts not paid by the 15th of each month will be charged a $5.00 service or late fee. The service or late fee will appear on the next months billing. Customers using payment coupon books are responsible for sending in a monthly coupon, with payment, on the 1st of each month.

6.7 Any account not paid by the 20th of the month will be suspended until payment is received. The customer will be charged a re-activation fee to re-establish the account.

6.8 The customer is liable for all cost of collection, including reasonable attorneys' fees, incurred by SOSI in the collecting of amounts due SOSI from the customer. The customer will be charged $25.00 for the first returned check and $35.00 thereafter. (Civ. Code: 1719)

6.9 Any customer who writes a check with the intent to defraud SOSI will be prosecuted to the fullest extent of the Law.

6.10 SOSI reserves the right to change its fees and charges at any time. SOSI desires to make the Internet an enjoyable experience for its customers. SOSI asks that its customers report any abuse of the Internet at once so we may correct any problems as they occur.

6.11 No account shall be activated until payment is received.

7.0 Equipment and service failure

7.0 The user agrees that service and equipment failures will occur from time to time. SOSI is not responsible for equipment failures or system failure caused by natural occurrences. SOSI will not be responsible for any lost data the user lose due to any failures. Business users use the internet at their own risk. SOSI is not responsible for the loss of revenues or information as a result of Internet or Network failure. Due to Phone and other services beyond the control of SOSI, SOSI does not guarantee a connection each time a user dials up.

7.1 Personal web sites are for personal use only. Business must be conducted with business web sites. Users are responsible for the maintenance and up keep of personal web sites. SOSI does not keep back up data of personal web sites and will not be responsible for any losses of data or information.

7.2 Business web sites: SOSI will only be responsible for the up keep and maintenance of the web sites that it is paid to care for. Sites maintained and created by outside vendors are the responsibility of the vendor. SOSI will not back up or be responsible for sites maintained or created by an outside vendor.
